While we attempt to ensure the accuracy of all posts on our social media platforms at all points, our terms and conditions apply on advertising and The Sharks reserve the final and exclusive right to make a decision concerning the accuracy, reliability and validity of the content on our social media platforms or on any other pages to which we link. The Sharks also reserve the right to remove, change or cancel any promotions, deals, special offers or pricing on our Social Media platforms at any time at our discretion.

SHARK CAGE TERMS AND CONDITIONS OF ONLINE PURCHASE AND SALE

  1. Ownership and Risk
    Please be aware that once your product is delivered to you, ownership of and risk in the product passes to you, too. We require a signature for any product delivered, at which point ownership passes to you. We advise checking to ensure your product is intact when receiving your purchase.
  2. Return Policy
    In the unlikely case you are not fully satisfied with your purchase then, subject to the terms set out in this Delivery and Returns policy, we will ensure that you obtain either a Shark Cage credit note of equal value or a cash refund.
  3. Damaged or Defective Product, or otherwise not what you ordered?

    1. Returned product(s) (and associated shipping and handling charges at standard rates) will either be refunded or replaced if the damage is the result of manufacturing defect or deviation from factory specifications. No refund shall be given if the product is damaged as a result of normal wear and tear.
    2. If the Sharks (Pty) Ltd assess the damage to be as a result of a manufacturing defect or a deviation from factory specifications, then in such cases, please allow 14 days from the day you return your package for your account to be credited, for the product to be replaced or for your account to be refunded.
    3. If the product delivered to you was not what you ordered, please allow 14 days from the day you returned the product for your account to be credited (such credit will include your reasonable shipping fees incurred in returning the item to us)
    4. We do not refund or replace products which were:
      1. obtained from a source other than this Website.
      2. damaged by abuse or negligence (exposure to chemicals, caustic substances, open flame, high heat, sharp objects etc.)
      3. damaged by misuse or activities other than the intended purpose.
  4. Personalised Products
    1. Please understand we are unable to accept returns or exchange product(s) that have undergone personalisation, unless they have been found faulty after detailed examination by the Sharks (Pty) Ltd. We ask that you choose your personalisation details carefully, and retain a copy of your confirmation notice for future reference. If it is found that we have incorrectly personalized your product(s) contrary to your instruction and the confirmation notice, we will gladly replace them.
  5. Return Instructions
    To return a product, please follow the instructions below:

    1. Send us an email at: nitha@thesharks.co.za. In your email, please include:
      1. Reasons for why you are returning the product(s); and
      2. Attach a copy of the payment confirmation you received when placing the order.
    2. Pack the product(s) into their original packaging including the original and attached labels/ swingtags in the case of clothing items.
    3. Address the package for the attention of Nitha Ramchunder at The Sharks (Pty) Ltd, Growthpoint KINGS PARK Stadium, 12 Isaiah Ntshangase Road, Durban, South Africa, 4001.
    4. As The Sharks (Pty) Ltd is not liable for the loss of any product being returned we highly recommend that you return it using registered mail or courier.
